09/12/08 – Charged with driving on Leyland Road whilst over the legal limit for alcohol 112/100
Guilty Plea entered.
Police on Mobile Patrol, travelling along Leyland Road at 1.05am, saw a vehicle stationary at a junction. The vehicle was straddling the lines, it was then driven forward onto the kerb before carrying on along Leyland Road. The vehicle was stopped and the driver was asked if he had been drinking. He answered “Probably too much” he was very unsteady on his feet when he got out of the vehicle. He was breath tested and a reading of 112/100ml of Breath was recorded.
Mr Archer for the defence said that sympathy for Drink Drivers is hard to come by however Mr Archer feels sorry for this defendant.
As far as this offence is concerned the defendant is appearing in Pantomime at the Southport Theatre, this occurred on the last day of rehearsal, he went for drinks at the Directors accommodation on Avondale Road. Mr French has digs in Albany Road. Around 80 paces away from where he parked his car. As he was leaving the directors he saw his car and realised that he had all his theatrical makeup still in the vehicle. He was concerned because he has had two vehicles broken into and two stolen. In hindsight he should have just taken the make-up out of the car and walked back to his digs.
However he decided to drive and he missed his turn off and so took the roundabout route, where the Police saw him. For the last two weeks he has been concerned that he could face a jail sentence as he had told Mr Archer the reading was 120/110.
He has co-operated fully with the Police and has a clean driving licence. Disqualification will cause him significant hardship because of the isolated location of his home and his need to travel to his work. He is a personal trainer as well as an actor.
The Bench asked for a fast track report from Probation. After the Bench had heard the report they imposed a Community Order of 100 hour unpaid work.
He will be disqualified from driving for 24 months however he was offered the DDRehab Course, which if successfully completed will reduce the ban by a quarter. He was also ordered to pay costs if £65.
